This Disclaimer governs your use of the Broker Seva mobile application and brokerseva.com (the "Platform"), operated by Broker Seva, a partnership firm ("Broker Seva", "we", "us", "our"). It forms part of, and should be read with, our Terms and Conditions. By using the Platform you accept this Disclaimer.
Broker Seva is a technology platform and neutral intermediary that enables verified real estate professionals ("Members") to discover, connect and collaborate. We are not a real estate agent, broker, dealer, valuer, financial advisor, legal advisor, or investment advisor, and we are not a party to any dealing between Members or between a Member and any third party.
2.1. All property listings, land bank entries, requirements, prices, measurements, availability, ownership and other information on the Platform are provided by Members or third parties, not by Broker Seva.
2.2. We do not independently verify, endorse, guarantee or warrant the accuracy, completeness, legality, title, ownership, marketability, condition, valuation or current availability of any property or information posted on the Platform.
2.3. Information may be inaccurate, outdated, incomplete or fraudulent. You must conduct your own independent due diligence — including verification of title, ownership, RERA registration, encumbrances, approvals and legal status — before acting on any information or entering into any transaction.
3.1. Verification features (including MahaRERA registration lookups and profile verification) rely on third-party and government data sources that may be incomplete, delayed or inaccurate.
3.2. A "verified" indicator means only that a check was run against available data at a point in time. It is not a certification, endorsement, or guarantee of any Member's identity, honesty, competence, licensing, financial standing, or of the accuracy of any listing. We are not liable for reliance on any verification status.
Nothing on the Platform constitutes legal, financial, tax, investment, valuation or professional advice. Any information, template, tool or resource provided (including any commission-agreement generation feature) is for convenience only and does not replace advice from a qualified professional. You should obtain independent professional and legal advice before entering into any transaction or agreement.
5.1. We do not control, and are not responsible for, the conduct, performance, honesty, solvency or legality of any Member or third party, whether online or offline.
5.2. Any co-broking arrangement, commission split, negotiation, agreement or transaction is solely between the Members and/or third parties involved, at their own risk. Broker Seva bears no responsibility or liability for the outcome, non-performance, dispute, loss, fraud or damage arising from any such dealing.
5.3. Any commission-agreement or contract feature merely helps Members generate documents between themselves. Broker Seva is not a party to, witness to, guarantor of, or responsible for the enforceability, performance or outcome of any such agreement.
We make no representation or warranty that use of the Platform will generate any leads, matches, deals, listings, commissions, income, business or particular outcome. Any examples, projections or testimonials are illustrative only and are not guarantees. Results depend on many factors outside our control.
The Platform is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted, timely, secure, or error-free, or that defects will be corrected. We may modify, suspend or discontinue any feature at any time.
The Platform may contain links to, or integrate with, third-party websites and services (including payment gateways, messaging providers and government/RERA sources). We do not control and are not responsible for their content, accuracy, availability, security or policies. Use of them is at your own risk and subject to their terms.
To the maximum extent permitted by law, Broker Seva and its partners, employees and agents shall not be liable for any loss, damage, cost or expense (direct, indirect, incidental, special or consequential) arising from your use of, or reliance on, the Platform, any information on it, any verification status, or any Member Transaction. This Disclaimer is subject to, and read together with, the limitation of liability provisions in our Terms and Conditions.
